Acceptance of Terms By accessing or using AdPeekr (the “Service”), operated by Bas Sanderink Marketing (KVK 78596432), you agree to these Terms of Service (“Terms”). If you do not agree, you must not use the Service.
Scope of Services AdPeekr provides a web-based platform that allows marketing managers and small-business owners to discover competitors’ advertising strategies and receive alerts on competitor activity.
Account Registration & Eligibility
You must register and create an account to access the Service.
You represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Subscription Plans & Billing
Plans: AdPeekr offers one free plan and three paid plans (Grow, Scale, Enterprise).
Billing: Subscription fees are billed monthly via Stripe. Accepted payment methods include credit card, PayPal, SEPA, and iDEAL.
Refunds: To request a refund, contact support@adpeekr.com. Refunds are granted at AdPeekr’s sole discretion.
Intellectual Property
All content, trademarks, logos, and data on AdPeekr are owned by or licensed to Bas Sanderink Marketing.
You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
You may not copy, modify, distribute, reverse-engineer, sublicense, or create derivative works based on the Service or any part thereof.
Acceptable Use & Prohibited Conduct You agree not to:
Scrape any pages or data.
Reverse-engineer, decompile, or disassemble the Service.
Spam, phish, or send unsolicited communications via the Service.
Resell, sublicense, or commercially exploit the Service or its data.
Copy AdPeekr branding or replicate its functionality in whole or in part.
Termination
User Termination: You may close your account at any time via the account settings.
AdPeekr Termination: We may suspend or terminate your access for violation of these Terms or for any reason, with or without notice.
Data Deletion: Account data will be retained up to three (3) years after last login. To request immediate deletion, email support@adpeekr.com.
Disclaimers & Warranties
The Service is provided “as-is” and “as available.”
AdPeekr makes no warranty that the Service will be uninterrupted, error-free, or completely accurate.
AdPeekr disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, AdPeekr’s total liability for any claim arising out of or relating to the Service shall not exceed the amount paid by you in the three (3) months preceding the claim.
AdPeekr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
Indemnification You agree to indemnify, defend, and hold harmless Bas Sanderink Marketing and its affiliates, officers, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
Governing Law & Jurisdiction These Terms are governed by the laws of the Netherlands. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
Class-Action Waiver & Arbitration
You and AdPeekr agree to resolve disputes through binding arbitration in the Netherlands, under the rules of a recognized arbitration institution (e.g., ICC).
You waive any right to participate in a class-action lawsuit or class-wide arbitration against AdPeekr.
Changes to Terms We may revise these Terms at any time. We will notify you by email and update the “Last updated” date. Continued use of the Service constitutes acceptance of the revised Terms.
